General Terms and Conditions of Sale (GTC) of Valberrys - SARL IVS Tendance
1. Introduction: These General Terms and Conditions of Sale ( GTC ) govern all sales made on the Valberrys brand website, operated by the company SARL IVS Tendance . Any order placed implies the customer's unreserved acceptance of these GTC .

3. Products and services: The products offered for sale by Valberrys consist primarily of men's and women's shoes, including, but not limited to, sneakers, sandals, and other fashion items. The essential characteristics of each product are indicated on the website at the time of ordering, in accordance with applicable legal provisions.
The photographs, graphics, and descriptions of the products are for illustrative purposes only and do not, under any circumstances, constitute a contractual obligation on the part of Valberrys . Slight differences may occur between the online presentation and the delivered product, without affecting the validity of the sale.
Product availability is guaranteed subject to existing stock. If the ordered product is unavailable, Valberrys will inform the customer as soon as possible and offer either an equivalent substitute product or a refund of the amount paid, in accordance with applicable legal provisions.
Valberrys reserves the right, at any time and without notice, to modify or remove products from its catalogue, without this modification giving rise to any compensation for the benefit of the customer, other than reimbursement of the price possibly already paid for the unavailable product.
Associated services, including international delivery, are specified to the customer during the ordering process and are subject to specific conditions which may vary depending on the destination, the chosen transport methods and applicable local regulations.
4. Price: The prices of products displayed on the Valberrys website are shown in euros, inclusive of all taxes (VAT), excluding delivery charges and any applicable customs duties depending on the destination country. Delivery charges and other additional fees are specified to the customer before final order confirmation.
For deliveries outside the European Union, the customer is responsible for paying all local taxes, customs duties, import fees, or other charges levied in the country of receipt. These charges are not the responsibility of Valberrys .
Valberrys reserves the right to change its prices at any time. However, the price charged is the one in effect at the time the order is validated by the customer.
5. Ordering: Orders are placed online via our website. Once the order is validated, a confirmation email is sent to the customer.
Placing an order on the website constitutes unreserved acceptance of these General Terms and Conditions of Sale . The contract is formed upon confirmation of the order by Valberrys , which will be notified to the customer by email.
Valberrys reserves the right to refuse any order in the event of a prior dispute relating to payment, suspicion of fraud or non-compliance with these Terms and Conditions by the customer.
6. Payment: Orders are payable by credit card or any other payment method offered on the website. The order will be shipped only after full payment has been received.
7. Delivery: Products are shipped to the address provided by the customer when placing the order. Delivery times are estimates and may vary depending on the destination and international logistics constraints.
Valberrys cannot be held responsible for delays attributable to the carrier, customs or unforeseeable and insurmountable circumstances constituting force majeure.
If the package is not received within a reasonable time, the customer should contact customer service so that an investigation can be opened with the carrier.
8. Right of withdrawal: In accordance with the applicable legal provisions regarding distance selling, the customer has a period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to justify reasons or pay penalties.
The product must be returned in its original condition, complete, unworn, and undamaged. Return shipping costs are the responsibility of the customer, except in the case of a defective product or one that does not conform to the order.
Valberrys will proceed with the refund of the corresponding amount within fourteen (14) days from receipt of the returned product.
9. Warranty and liability: The products sold by Valberrys benefit from the applicable legal guarantees, namely:

The legal guarantee of conformity , provided for in Articles L.217-3 et seq. of the Consumer Code (for customers located in the European Union).

The guarantee against hidden defects , provided for in articles 1641 et seq. of the Civil Code, is applicable worldwide.
In the event of non-conformity or a hidden defect, the customer must notify Valberrys as soon as possible, providing all supporting documentation (photographs, description of the defect, order number, etc.). Valberrys undertakes, as appropriate, to replace the product or issue a refund, at no cost to the customer.
10. Personal Data: The data collected during the ordering process is intended for Valberrys and its service providers for order and delivery management. In accordance with the French Data Protection Act (Loi Informatique et Libertés), the customer has the right to access, modify, and delete their personal data by contacting customer service.
11. Intellectual Property: All elements of the Valberrys website (texts, images, logos) are protected by intellectual property rights. Any reproduction, in whole or in part, of the website is strictly prohibited without prior authorization.
12. Responsibility: Valberrys cannot be held liable for non-performance or poor performance of the contract attributable to the client, to the unforeseeable and insurmountable act of a third party, or to a case of force majeure as defined by international jurisprudence (natural disasters, strikes, armed conflicts, logistical disruptions, etc.).
In any event, Valberrys ' liability is strictly limited to the amount of the disputed order.
13. Disputes: In the event of a dispute, these Terms and Conditions shall be governed by French law. If an amicable resolution cannot be reached, the competent court shall be that of the registered office of SARL IVS Tendance .
14. Modification of the Terms and Conditions: Valberrys reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect at the time of the order.
